Warranty Policy

1. Legal Warranty

In accordance with Portuguese and European Union consumer protection law (Decree-Law No. 84/2021, transposing Directive (EU) 2019/771), all products sold by Seal & Shelf benefit from a legal warranty of conformity. This warranty protects you against any lack of conformity that exists at the time of delivery.

2. Warranty Duration

The warranty period varies depending on the condition of the product at the time of sale:

  • Sealed / New products: 3-year legal warranty from the date of delivery, as provided by Portuguese law for new goods.
  • Like New / Used products: 18-month warranty from the date of delivery. Under Portuguese law, the warranty for used goods may be reduced to a minimum of 18 months by agreement between the parties.
  • Presumption of non-conformity: Any lack of conformity that becomes apparent within 1 year of delivery (for new goods) or 1 year (for used goods) is presumed to have existed at the time of delivery, unless proven otherwise.

3. What Is Covered

The warranty covers any lack of conformity of the product, including defects in materials or workmanship, products that do not match the description provided, and products that are not fit for the purpose for which they were sold. The product must conform to what is reasonably expected based on its condition (Sealed, New, or Like New) as described at the time of purchase.

4. What Is Not Covered

The warranty does not cover:

  • Damage caused by misuse, negligence, or unauthorized modifications
  • Normal wear and tear consistent with the product's age and condition
  • Damage caused by exposure to liquids, extreme temperatures, or power surges
  • Cosmetic defects that were disclosed in the product description at the time of sale

5. Your Rights Under Warranty

If a product is found to be non-conforming within the warranty period, you are entitled to the following remedies, in this order of priority:

  • Repair of the product, free of charge
  • Replacement of the product with a conforming unit, if repair is not possible
  • Price reduction proportional to the defect, if neither repair nor replacement is feasible
  • Full refund (termination of the contract) if the lack of conformity is significant

6. How to Claim the Warranty

To exercise your warranty rights, please contact us with your order number, a description of the issue, and photographic evidence if applicable. We will assess your claim and respond within 5 business days. If a return is required, we will provide shipping instructions and cover the return costs for valid warranty claims.
